Mangrovery, LLC Terms and Conditions of Sale of Non-Custom Items 

These General Terms and Conditions of Sale ("Terms") apply to all sales of non-custom goods from Mangrovery.com or our affiliated websites ("Website," "we," "us," "our") to you, the customer ("you," "your"). By placing an order with us, you agree to be bound by these Terms.

1. Products
   1. Product Descriptions: We make every effort to display accurate product descriptions and images. However, we do not warrant that product descriptions or other content on the Website are completely accurate, complete, reliable, current, or error-free. 
   2. Availability: All products shown on the Website are subject to availability. We reserve the right to discontinue any product at any time for any reason.
      
      
2. Orders
   1. Acceptance: Your order constitutes an offer to purchase the products. All orders are subject to our acceptance, which will be confirmed by an order confirmation email. We reserve the right to refuse or cancel any order for any reason, including limitations on quantities available for purchase, inaccuracies in product or pricing information, or problems identified regarding fraud. 
   2. Pricing: Prices for products are subject to change without notice. The price charged will be the price in effect at the time the order is placed.
      
      
3. Payment
   1. Payment Methods: We accept various forms of payment, as indicated on the Website. You agree to provide us with current, complete, and accurate purchase and account information for all purchases made through our Website or otherwise.  
   2. Taxes and Shipping Costs: Prices do not include applicable taxes, duties, tariffs, or charges which are your responsibility to pay. Applicable sales tax will be added to all taxable sales unless you provides a valid exemption certificate prior to placing your order. Tax is calculated based on the final delivery address.
      
      
4. Shipping and Delivery
   1. Shipping: We will arrange for the shipment of the products to you. Shipping and delivery dates are only estimates. Estimated production and delivery timelines are provided in good faith BUT ARE NOT GUARANTEED.
   2. Risk of Loss: All products and goods are shipped FOB Origin (Mangrovery, LLC’s location), unless otherwise agreed. Title and risk of loss pass to the buyer upon delivery to the carrier or upon customer pickup.
      
      
5. Returns and Refunds 
   1. Return Policy: All sales are final.
   2. Refunds: Refunds are not accepted except in cases of material defects or proven material seller error. Any issues must be reported in writing within 7 calendar days of delivery.
      
      
6. LIMITATION OF LIABILITY 
   TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY FOR ANY DAMAGES, INCLUDING WITHOUT LIMITATION, DIRECT OR INDIRECT, CONSEQUENTIAL, INCIDENTAL, PUNATIVE, SPECIAL, OR ANY OTHER LOSS OF PROFITS OR GOODWILL, ARISING IN CONNECTION WITH THIS WEBSITE OR THE USE THEREOF OR THE INABILITY TO USE THE WEBSITE BY ANY PARTY, OR IN CONNECT WITH ANY FAILURE OF PERFORMANCE, DEFECT, INTERRUPTION OR DELAY IN OPERATION.  OUR LIABILITY FOR ANY CLAIM RELATED TO A TRANSACTION SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU FOR THE ORDER IN QUESTION.
   
   
7. WARRANTY.
   All information and materials contained and sold through this Website, unless designated otherwise, are sold “as-is”. EXCEPT AS EXPRESSLY SET FORTH HEREIN, MANGROVERY, LLC MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
   
   
8. Governing Law and Venue 
   This agreement is governed by the laws of the State of Wisconsin and, where applicable, by federal law. Any disputes arising from this agreement shall be subject to the exclusive jurisdiction of the state or federal courts located in Dane County, Wisconsin, and you consent to such venue.
   
   
9. Changes to Terms
   We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms by posting updates and changes to our Website. It is your responsibility to check our Website periodically for changes. Your continued use of or access to our Website following the posting of any changes to these Terms constitutes acceptance of those changes.
   
   
10. Successors and Assigns
    This agreement inures to the benefit of and is enforceable by our successors and assigns. We may assign this agreement without providing written notice to you.
     
11. Headings
    Headings and other captions contained in this agreement are for reference purposes only and do not interpret, define or limit the scope, extent or intent these Terms or any provision thereof. 
    
    
12. Severability
    If any provision of these Terms is held invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired thereby.
